Don't be misled by false information: Measure B now more than ever
Don't be fooled by last-minute allegations that Measure B is unconstitutional.
The No on B campaign has launched a last-minute effort to confuse voters with the claim that a recent California Appellate Court decision makes Measure B unconstitutional. This is untrue. Measure B is a valid voter initiative. The recent court decision doesn’t change that.
People v. Kelly concerned a provision in state law that defines how much marijuana can be possessed by a patient as "medical," without a doctor's specific recommendation for a greater quantity. The California Appellate Court found the "default" limit under state law (6 mature plants and one-half pound dried marijuana) constituted an amendment to voter-approved Proposition 215 which set up the compassionate medical marijuana program in 1996. Since only voters can amend a voter initiative, the Appellate Court said the specific 6-plant/one-half pound limit was unlawful.
The State Attorney General plans to appeal this ruling to the State Supreme Court. The Attorney General will undoubtedly argue that the limit under state law is a lawful implementation of Proposition 215, rather than an amendment, and will cite prior Supreme Court decisions that seem to be consistent with that interpretation. The Supreme Court has noted in a prior decision, that state law allows a medical patient to possess as much marijuana as a doctor recommends regardless of the guideline of 6 plants/one-half pound.
It doesn't matter how this court issue is resolved. Measure B will make Mendocino County's medical marijuana standards the same as the rest of the state, regardless of what the statewide rule is. Anyone claiming their marijuana is protected as legitimate medical marijuana will have to be able to justify that claim. People growing dozens or hundreds of plants, storing huge amounts of dried bud, and hiding thousands of dollars in cash under their floorboards won't have a shield against the law, provided law enforcement is willing to enforce the law.
Measure B is a voter mandate to tell our public officials that protection against public nuisance, threats to public safety, and environmental damage have to come before marijuana growers' desire to grow as much as they want wherever they want, regardless of its impacts.
We need to pass Measure B now more than ever.
