Proposition 215: Compassionate Use Act of 1996

Approves marijuana cigarettes as a safe and effective medicine for treating nausea, AIDS wasting, glaucoma, arthritis, spasticity, migraine headaches, and "any other illness for which marijuana provides relief."

Attempts to invalidate federal Food and Drug Administration regulations that govern approval of new medications, federal drug-control laws, and international drug-control treaties.

However, federal law and international treaties prevail over state law.

SB 420 - Medical Marijuana

Existing law, the Compassionate Use Act of 1996, prohibits any physician from being punished, or denied any right or privilege, for having recommended marijuana to a patient for medical purposes.

The act prohibits the provisions of law making unlawful the possession or cultivation of marijuana from applying to a patient, or to a patient's primary caregiver, who possesses or cultivates marijuana for the personal medical purposes of the patient upon the written or oral recommendation or approval of a physician.

11362.5 H&S - Health & Safety Code - Compassionate Use Act of 1996

The people of the State of California hereby find and declare that the purposes of the Compassionate Use Act of 1996 are as follows:

(A) To ensure that seriously ill Californians have the right to obtain and use marijuana for medical purposes where that medical use is deemed appropriate and has been recommended by a physician who has determined that the person's health would benefit from the use of marijuana in the treatment of cancer, anorexia, AIDS, chronic pain, spasticity, glaucoma, arthritis, migraine, or any other illness for which marijuana provides relief.

(B) To ensure that patients and their primary caregivers who obtain and use marijuana for medical purposes upon the recommendation of a physician are not subject to criminal prosecution or sanction.

(C) To encourage the federal and state governments to implement a plan to provide for the safe and affordable distribution of marijuana to all patients in medical need of marijuana.

Measure G - Cannabis Personal Use Ordinance for Mendocino County

Sec. 9.36.020 Purpose.
The Ordinance codified in this Chapter will:

(A) Instruct the County government to support all efforts toward the decriminalization of marijuana.

(B) Instruct the County Sheriff and District Attorney to make marijuana enforcement their lowest priority with respect to other crimes.

(C) Establish a maximum limit of plants and weight for cultivation and possession of marijuana for personal use in Mendocino County, and prohibit the expenditure of public funds for enforcement of marijuana laws against cultivators and users in possession of quantities below that limit.

(D) Remove the fear of prosecution and the stigma of criminality from people who harmlessly cultivate and/or use marijuana for personal medical or recreational purposes.

(E) Extend police protection to those growing or possessing marijuana for personal use.

(F) Provide for the continued enforcement of marijuana laws against those who cultivate, transport and possess marijuana for sale.

The purpose of this Chapter is to establish Cannabis enforcement policy for Mendocino County. (Measure G-2000, passed Nov. 7, 2000.)
